RESUMO: A aplicação integrada dos princípios relacionados ao acesso ao conhecimento tradicional e ao patrimônio genético com os objetivos da CDB constitui o link jurídico entre o direito indígena e das minorias com o direito da sociedade envolvente, desdobrando-os com efetividade e ligando todo o sistema jurídico de modo suficientemente elástico e eficaz, para então alcançar a compatibilidade entre o direito consuetudinário, na prática, com o direito positivo vigente. Essa aplicação integrada dos princípios e do devido procedimento do consentimento prévio informado parece ser em última ratio a meta da CBD ao compor o tríade de objetivos: conservação da biodiversidade, utilização sustentável de seus componentes e repartição justa e eqüitativa dos benefícios derivados da utilização dos recursos genéticos, mediante acesso adequado.

ABSTRACT: The integrated application of principles related to access to traditional knowledge and to genetic patrimony with the objectives of the CBD constitutes the legal link between indigenous and minority law and the law of the surrounding society, clearly exposing them and holding together the overall legal system in a sufficiently flexible and effective manner, so as to achieve compatibility in practice between customary law and prevailing statutory law. The integration of the application of these principles and the due observance of prior informed consent procedures seems to be the ultimate goal of the CBD’s three objectives: conservation of biodiversity, sustainable use of its components and fair and equitable sharing of benefits derived from the use of genetic resources, through appropriate access.
