RESUMO: Este Trabalho tem como objetivo esclarecer algumas dúvidas sobre a possível regulamentação, por parte do Estado, da Antecipação Terapêutica do Parto no caso de fetos anencefálicos, promovendo conseqüentemente uma reflexão sobre um tema que está na fronteira dos direitos fundamentais, da moralidade, da saúde pública, e da religião. Levar-se-á em conta nessa análise os Direitos Fundamentais que serão concretizados com essa operação terapêutica, tomando como base o princípio da dignidade humana, garantindo condições mínimas de vida e desenvolvimento do ser humano.

ABSTRACT: This work aims to clarify some doubts on the possible regulation, by the state, of Anticipation of Childbirth therapy in the case of anencephalic fetuses, thus promoting a reflection on a topic that is on the borderline of fundamental rights, morality, public health , and religion. Bringing will regard this analysis Fundamental Rights which will be achieved with this operation therapy, based on the principle of human dignity, ensuring minimum living conditions and human development.
